These terms are between you and WeldonPC.com (Garfield Heights, Ohio), which runs Instalign Golf at instalign.net.

1. The service

Instalign Golf is an online golf game. It is a game only: it does not measure a real golf swing. The course Lanternwood is invented, and the site is not affiliated with any golf course, tour, club maker or governing body. No wagers, no entry fees and no prizes of any value. Scores have no monetary value.

2. Accounts

You can play the first three holes without an account. An account costs nothing and is needed to buy rounds or a pass. Accounts are for people aged 13 or over. Keep your password to yourself. You can delete your account at any time from the account page.

3. What is free and what is paid

The first three holes of Lanternwood, and practice on those holes, are free for everyone, as often as you like. A full nine-hole round costs one round credit, or is covered by a Clubhouse Pass. Prices are in US dollars and payment is through PayPal, which requires the payer to be 18 or over.

• Round credits: one round for $1.00, or five rounds for $5.00, paid once. A credit is used only when your round passes the third hole; it is then spent whether you finish that round or leave it. Credits do not expire, and an account that holds unused credits is never removed for being inactive. They cannot be traded, given away or exchanged for money.
• Clubhouse Pass: $1.95 a month or $19.50 a year for unlimited rounds, renewing automatically until you cancel.

The pricing page lists exactly what a paid round includes at the time you buy. Paying gives no advantage in play: everyone has the same clubs and the same physics.

While the site is in preview nothing is sold and nothing is charged; the whole course is open, and the prices shown are the prices from launch.

4. Cancelling, refunds and returned credits

You can cancel a Clubhouse Pass at any time from your account page, which cancels the PayPal subscription, or in PayPal itself. No further payments are taken and the pass keeps working until the end of the period you paid for.

WeldonPC refunds any charge, for a pass or for round credits, if you ask within 7 days of that charge (email weldon@weldonpc.com). When a purchase of round credits is refunded, its unused credits are removed; a refund of part of a purchase removes only the unused credits that part paid for. If a refunded credit is in use in a round that is still being played, that round goes back to being a free three-hole round and is not saved. Outside that, there are no refunds for part of a period or for used credits except where the law requires them.

If a round you paid for with a credit cannot be saved because of a fault on our side (for example the game is updated while you are playing), or our check cannot confirm it, the credit is put back on your account automatically; the automatic return for unconfirmed rounds is limited to three in any 30 days, after which you can write to us. A game that fails to load costs nothing, because no credit is used before the fourth tee.

Deleting your account cancels a running Clubhouse Pass at PayPal first and gives up any unused round credits.

5. Saved rounds and the game handicap

Full rounds played signed in are checked by replaying them on our server (see Fair Play) and saved to your account. A round we cannot confirm is not saved. The free three-hole taster is not saved. The game handicap is a number for this game only; it is not an official handicap and has no standing at any real course.

6. Fair use

Do not try to break or overload the site. We may remove rounds that were not produced by playing, and close accounts used to do so.

7. Changes and availability

We try to keep the course available every day but cannot promise it. If we change these terms in a way that matters to people who have paid, we will say so on the site and by email before the change applies to your next renewal. A price change never affects credits you already hold.

8. Liability

The site is provided as it is. To the extent the law allows, WeldonPC's total liability to you is limited to what you paid in the last 12 months. Ohio law governs these terms.
